These Terms of Service (the "Terms") set out the conditions for using Omoi (the "App"). Please read them carefully before using the App.
The App provides a service that encrypts and stores photos and videos (the "memories") you select, and allows you to restore them when needed.
Use of the App requires creating an account through Sign in with Apple. Account information management is the user's responsibility.
Users must not:
Memories entrusted to the App are kept quietly for 180 days (six months) from the day of entrustment. During this period, restore operations cannot be performed. This condition applies uniformly to all users regardless of subscription plan or duration.
Memories that have passed the 180-day mark may be requested to be restored at any time.
Within the per-month limits on item count and capacity defined by your subscription plan, you may request memories to be restored. The specific limits are shown in the "Restore Rules" screen and the plan detail screens inside the App.
The limits are calculated by calendar month in Japan Standard Time (JST) and reset at 0:00 (JST) on the 1st of each month. If either the item count or capacity limit is reached, please request again after the next reset.
The App is provided as a subscription through the App Store. Pricing, storage capacity, and plan details are shown inside the App or on the App Store. We will notify you in advance of any pricing changes.
Plan changes (upgrades and downgrades) are processed according to Apple's specifications, and proration is automatically calculated by Apple.
You cannot entrust new memories beyond your storage capacity, but the Operator will not delete memories already entrusted for capacity reasons.
If you cancel your subscription, the Operator commits to the following:
The costs of fulfilling this section are borne entirely by the Operator.
The Operator may change or discontinue the service when deemed necessary. Upon service termination, memory delivery in accordance with Section 7 will be carried out.
The Operator is not liable for any damages arising from use of the App, except in cases of intentional or gross negligence. We recommend that users back up important memories on their own as a precaution against unforeseen events.
Refunds are determined according to Apple's refund policy. The App does not participate in refund procedures. Even if a refund is granted, memory retention and delivery as set out in Sections 4 and 7 will continue under these Terms.
These Terms are governed by the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court for the first instance.
